GRUPO ALOJICA AenP, its subsidiaries, affiliates and related entities belonging to the same corporate group, a company incorporated under the laws of the Mexican Republic, and is domiciled at Teotihuacan Num. Ext. 18, Hipódromo, Cuauhtémoc, Ciudad De México, C.P. 06100, México hereinafter referred to as “ALOJICA “, is in charge of the management of the www.alojica.com Website and the Related Websites.
PURPOSE AND SCOPE
These Terms and Conditions (hereinafter, the “T&Cs”) are intended to regulate the activities carried out on our website and the Related Websites, including, but not limited to (i) the online consultation of our information on the different real estate projects of the companies belonging to ALOJICA; (ii) the management of visits to the sales offices and/or departments and/or sample offices of our real estate projects; (iii) the sending and receiving information related to job opportunities at ALOJICA companies, as well as promotional and telemarketing communications of our projects, and other projects and services that may be enabled in the future on the site and/or our related websites (hereinafter the “ONLINE SERVICES”). Some of the ONLINE SERVICES require various prior acts of registration involving the provision of personal data by You (hereinafter referred to as the “USER”) in accordance with the requirements set forth in the DIALOGUE WINDOWS of the Website or the Related Websites.
In addition to the current T&Cs, the use of the Website and the Related Websites shall also be subject to the other Policies and Notices of ALOJICA, including our Privacy Notices, which are hereby reproduced as if included herein as well as to the instructions that are published on the Website www.alojica.com and/or the Related Websites.

UPDATES
You agree to periodically review the current T&Cs, since they may be modified at any time by ALOJICA through a prominent notice. Some of the ONLINE SERVICES available to the USER have accessible administration and management facilities that require the use of passwords (“User Name” and “Password”), that may be assigned by ALOJICA or selected by you, to verify your identity as a USER. You acknowledge that any transaction correctly identified with such Username and Password will be considered as validly carried out by you in your capacity as USER. Therefore, you must refrain from disclosing your Username and Password to other people, making a personal use of them, and if you become aware that another person has had access to the same or has accessed the Website www.alojica.com , as well as the Related Websites with your Username and Passwords without your consent, you must notify such circumstance immediately and in writing to the following e-mail address: info@alojica.com
CONSIDERATION
The provision of the ONLINE SERVICES is not subject to the payment of any consideration by You.
ALOJICA’S OBLIGATIONS
ALOJICA agrees to provide you, in a timely manner, with the ONLINE SERVICES requested under the terms that ALOJICA provides on its Website and its Related Websites.
PRIVACY NOTICE: ALOJICA is respectful of your privacy and of your personal data, and therefore asks you to carefully read the Privacy Notices available at www.alojica.com
INDUSTRIAL AND INTELLECTUAL PROPERTY: The parties agree that the elements and contents of the Website and the Related Websites, including but not limited to the various commercial notices, trademarks, trade names, logos, trade dress, and service marks, domain names, images, graphics, texts, animations, sounds, industrial designs, computer programs, data bases, reservations of use, design and format of the Web pages, and others, are protected under the national laws, international treaties and by contractual instruments and, in general, the ownership of the intellectual and industrial property rights correspond exclusively to ALOJICA and/or the companies of the Alójica Group. The USER acknowledges and accepts that he/she does not acquire any right over the aforementioned intellectual and industrial property assets by simply accessing and using the ONLINE SERVICES offered on the Website and/or on the Related Websites.
With the exception of the temporary copy that the USER downloads to the memory of his or her computer system to access the ONLINE SERVICES offered on such Websites, the USER shall not store, transmit, retransmit, reproduce, transfer for any reason whatsoever or distribute, any title or any element or content of the Website and/or the Related Websites. At no time shall access to the Website and/or the Related Websites and the use of the ONLINE SERVICES constitute an authorization or license to use such services or the elements and other contents of the Website and/or the Related Websites for purposes other than those provided for in these T&Cs.
ALOJICA prohibits any access link, whether by means of links, hyperlinks, banners, buttons, framing of or to (Frames) the ONLINE SERVICES offered on the Website and/or on the Related Websites. Likewise, ALOJICA prohibits the enabling, use or distribution of the SERVICES offered on such Websites or any other website, unless ALOJICA has granted the corresponding prior written authorization.
ALOJICA reserves the right to disable any access link that it deems inappropriate, for any reason. Any right not expressly granted under these T&Cs is reserved. The USER undertakes to: (i) abstain from carrying out any act that could affect or diminish the rights over the industrial and intellectual property assets of ALOJICA and/or of the companies of the ALOJICA Group, and (ii) refrain from any other use that could result in a benefit to himself or herself or any other third party. In addition, the USER is expressly prohibited from using, translating, or modifying, in whole or in part, the aforementioned intellectual and industrial property assets, for the production of any derivative work, compilation or database, or for any other purpose other than that expressly authorized.
LINKS TO THIRD PARTY WEBSITES: The Website and/or the Related Web Sites may contain links to third party websites for your convenience and information. In the event that you access these links, you will be leaving the Website and/or the Related Web Sites. Regardless of whether ALOJICA enters into contracts with such third parties and communicates their Privacy Notices to you, ALOJICA has no control over such websites or their terms and conditions, their privacy notices, policies or practices, nor over their content, products, services, materials or any other information contained on or available through such websites, which may differ from these T&Cs.
The inclusion of links to third party websites should in no way be construed as a recommendation by ALOJICA of their products and services.
ALOJICA does not assume any responsibility for third party websites and advises you to review their Terms and Conditions, notices, policies and/or privacy practices. Access to any website linked to and/or Related Websites is at your own risk.
The USER understands and accepts that ALOJICA has no control over the access to the Internet Protocol (IP) by persons who attempt to violate the security of the network and equipment of ALOJICA or the USERS. Therefore, ALOJICA cannot guarantee that all applications and ONLINE SERVICES of the and/or the Related Websites are free of risks.
ALOJICA undertakes to take reasonable measures to protect the information generated, received, transmitted, or stored on the Website and/or the Related Websites, such as the use of software to combat malicious code and firewalls, among other measures; however, disclaims any and all liability, including any damages, which may be caused by the misuse of the information of ALOJICA equipment and of the USER in the event that a third party violates the security and unlawfully uses such information.
ALOJICA excludes any civil, administrative, or criminal liability, for direct or indirect damages, or any other damages caused or derived from: (i) the presence of viruses or other malicious codes derived from attacks by third parties to the Website and/or to the Related Websites or third party websites linked to these sites and which may cause alterations in the USER’s computer systems and/or electronic files; (ii) the impossibility to use the Website and/or the Related Websites, or of their online services or of any of its parts, or of its Links, including any damage to the USER’s computer programs; (iii) the use and information available in any Link to the Website and/or the Related Websites; (iv) the knowledge that unauthorized third parties may have of the conditions, characteristics and circumstances of the use that the USER makes of the Website and/or the Related Websites; and (v) the misuse by third parties of the information generated, received, transmitted, or stored on the Website and/or the Related Web Sites;

You also agree not to use the elements, contents and services of the Website and/or the Related Web Sites for the purpose of sending Related Websites unsolicited e-mail (spam), whether commercial, proselytizing or of any other nature, or for sending chain data messages, commercial pyramid schemes, contests, messages that are defamatory, obscene, pornographic, or that violate the intellectual or industrial property rights of ALOJICA, of the companies of the Alojica Group or of any third party. Likewise, you shall refrain from processing, transmitting and distributing any type of malicious code, including, but not limited to, viruses, worms, back doors, Trojan horses, Zombies, logic bombs or any computer program, application or file that may affect, damage or prevent the correct functioning of the elements, contents and services of the Website and/or the Related Websites or the computer systems and telecommunications equipment of Alojica, of the companies of the Alojica Group or of any third party.
ALOJICA reserves the right to delete any file, application or data message that contravenes the provisions of this section, or that is in violation of any federal or state regulatory provision or that violates good customs.

If ALOJICA makes any significant changes, it will also notify you by other means such as sending you an e-mail if you have registered as a USER.
If you do not express your opposition to these changes through the use of the DIALOG WINDOWS or other electronic means such as email and you continue to use the Website and/or the Related Websites, You will be deemed to have accepted the changes and the T&Cs with their modifications, shall be deemed to be in full force and effect.
No legal relationship of representation, partnership or employment is created by virtue of these T&Cs, so that neither you nor ALOJICA will act as the other’s representative nor may they obligate or bind you before third parties, nor before their respective employees.
DISCLAIMER: You acknowledge that in the current T&Cs there is no error, unjust enrichment, fraud, deceit, fraudulent misrepresentation, fraudulent intent, injury, violence, or any other consent defect that could affect its validity and legal effectiveness and therefore you hereby waive any action that may correspond to you for such concepts, subscribing to these T&Cs fully aware of its content and legal scope.

You indicate as your domicile and location to receive notifications related to these T&Cs the one indicated on the Dialogue Window on the Website and/or the Related Websites. Any change of address must be notified to the other party within 10 days of the date in which it was effected, by e-mail with acknowledgement of receipt or through the mechanisms provided for in the DIALOGUE WINDOWS. In case of failure to comply with this obligation, ALOJICA may terminate these T&Cs, without prejudice to the fact that any notification shall be effective at the previous address.
CONSENT
In terms of the Federal Civil Code and the Code of Commerce, your e-mail address and your password will be considered as your consent and your password to access the ONLINE SERVICES shall be considered an equivalent to your wet signature, for which reason it will be presumed, unless proven otherwise, that the information subscribed by You using such means, will be valid and will have full legal effects.
APPLICABLE LAW AND JURISDICTION
The interpretation and application of these Terms and Conditions is governed by the federal laws of Mexico. The parties expressly and irrevocably agree to submit to the jurisdiction of the competent courts of Mexico located in Mexico City, Mexico with respect to any claim, action or proceeding arising out of or relating to the T&Cs and irrevocably waive any other jurisdiction that may correspond to them by reason of their present or future domiciles or for any other reason.
TERM
These T&Cs will be in force for an indefinite period of time and will begin once you have consented herein.
MANIFESTATION OF CONSENT: In my capacity as User of the Website and/or the Related Websites I expressly declare I accept, without reservation or limitation, the contents of these T&Cs by clicking on the “accept” button at the bottom of this screen.
I also declare under oath that I have legal capacity to contract, that I have read these T&Cs in its entirety, that I have fully understood them, and that all the data that I have entered in the DIALOGUE WINDOWS of the Website and/or the Related Websites are true and accurate.
